SayeBook Terms of Service

1. Eligibility

You must be 18 years of age or older to create a SayeBook account or use account-based SayeBook services.

By creating an account, you represent that you are at least 18 years old and have the legal capacity to agree to these Terms.

SayeBook does not currently offer accounts for individuals under 18.

Books intended for children or teenagers may be available through SayeBook, but this does not change the minimum age required to hold a SayeBook account.

2. Accounts

You are responsible for providing accurate account information and keeping your login credentials secure.

You are responsible for activity occurring through your account unless caused by circumstances outside your reasonable control.

You may not share credentials for the purpose of bypassing purchasing, licensing, security, or access restrictions.

You may not impersonate another person, create accounts for fraudulent purposes, or use another person's account without authorization.

3. SayeBook Marketplace

SayeBook is a digital marketplace for eBooks and audiobooks.

Availability, pricing, formats, languages, and other characteristics may vary by title.

The price and availability confirmed by SayeBook's servers at checkout are authoritative for the transaction.

If we discover a material pricing, availability, or technical error before delivery, we may cancel the affected transaction and issue a full refund.

4. Digital Content License

Unless expressly stated otherwise, purchasing an eBook or audiobook does not transfer copyright or ownership of the work to you.

Your purchase grants you a limited, personal, non-exclusive and non-transferable license to access and enjoy the purchased title for personal use, subject to these Terms and applicable law.

You may not unlawfully reproduce, redistribute, resell, publicly distribute, commercially exploit, or circumvent technological protection measures associated with digital content.

Nothing in these Terms is intended to restrict rights that cannot lawfully be restricted under applicable law.

5. Your Digital Library

Purchased titles may be made available through your SayeBook digital library and through other authorized delivery methods provided for the title.

A title may later be withdrawn from sale by SayeBook or its rights holder.

Where reasonably possible and legally permitted, withdrawal from future sale will not by itself remove a previously purchased title from an eligible customer's library.

However, continued access cannot be guaranteed where removal is required because of copyright or other legal claims, security concerns, loss of distribution rights, technical limitations, or other circumstances requiring SayeBook to restrict access.

Where appropriate, SayeBook may provide another remedy consistent with applicable law and our Refund Policy.

6. Orders and Payments

You agree to pay the amount displayed and confirmed at checkout.

Payment processing may be provided by third-party payment providers.

SayeBook does not store full payment-card numbers when those details are handled directly by our payment provider.

Taxes or other legally required charges may be added where applicable.

7. Refunds

Refund eligibility is governed by the SayeBook Refund Policy, which forms part of these Terms.

Nothing in these Terms or the Refund Policy limits consumer rights that cannot legally be waived or excluded.

8. Reviews and Community Features

SayeBook may allow users to post reviews, ratings, comments, profile information, reactions or other community content.

You retain ownership of content you create, subject to the rights reasonably necessary for SayeBook to host, display, reproduce, moderate and operate that content as part of the service.

You must have the right to post what you submit.

Community activity must comply with SayeBook's Review Guidelines, Content Guidelines and Acceptable Use Policy, as applicable.

SayeBook may moderate or remove content that violates its policies or applicable law.

9. Intellectual Property

The SayeBook name, logo, interface, software, original editorial materials and other SayeBook-owned materials are protected by applicable intellectual-property laws.

Books, covers, audio recordings and other materials offered through SayeBook remain subject to the rights of their respective authors, publishers, licensors and other rights holders.

A purchase does not grant rights beyond the applicable customer license.

10. Acceptable Use

You may not misuse SayeBook. Among other things, you may not attempt to:

• interfere with or disrupt the service;
• gain unauthorized access to accounts, systems or data;
• circumvent security or access controls;
• scrape or harvest the catalogue or user information at prohibited scale;
• manipulate reviews, ratings or platform activity;
• distribute malware or harmful code;
• commit fraud or impersonation; or
• upload or distribute material you do not have the right to provide.

11. Suspension and Termination

SayeBook may restrict, suspend or terminate accounts when reasonably necessary to address fraud, security threats, material or repeated violations of these Terms or other SayeBook policies, infringement, unlawful activity, or legal requirements.

Where appropriate, we may provide notice or an opportunity to address the issue.

Termination does not eliminate obligations or liabilities that arose before termination.

12. Service Availability

We work to keep SayeBook available and reliable, but we do not guarantee uninterrupted or error-free operation.

Maintenance, security incidents, provider outages, technical failures, legal requirements and other circumstances may temporarily affect availability.

13. Third-Party Services

Certain SayeBook functions depend on third-party providers, such as payment processing, hosting, authentication, email delivery and infrastructure services.

Your use of certain third-party services may also be subject to those providers' applicable terms or privacy practices.

14. Disclaimers

To the extent permitted by applicable law, SayeBook is provided on an “as available” basis.

We do not guarantee that every title, feature, author, publisher or service will remain available indefinitely.

Nothing in these Terms excludes warranties, guarantees or consumer protections that cannot legally be excluded.

15. Limitation of Liability

To the fullest extent permitted by applicable law, SayeBook and its operator will not be liable for indirect, incidental, special or consequential losses arising from use of the service where such liability may lawfully be limited.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

16. Changes to These Terms

We may update these Terms when SayeBook's services, legal obligations or business practices change.

When changes are material, we will provide appropriate notice and update the effective date or version information.

Changes will not retroactively remove rights that applicable law does not permit us to remove.

17. Governing Law

These Terms are governed by the laws applicable in the State of Maryland, United States, without regard to conflict-of-law principles, except where mandatory consumer laws or other applicable laws provide otherwise.

Nothing in this section deprives consumers of protections or remedies that cannot lawfully be waived.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

19. Entire Agreement

These Terms, together with the SayeBook policies expressly incorporated into them, constitute the agreement governing your use of SayeBook with respect to the matters they cover.
